Justice for leaky condo victims
We are happy to report that an initiative to
assist leaky condo victims is proceeding. Owners whose buildings were
constructed between 1987 and 1994 and who have unsettled damages to the common
property will be interested.
A story in the Peace Arch News on September 7, 2005
described the efforts of a Vancouver law firm, Singleton Urquhart LLP to launch
a class action suit against the Canada Mortgage and Housing Corporation on
behalf of owners of units in four- (or three?) storey wood frame buildings
constructed with face-sealed stucco walls who have suffered financial losses
from water damage.
The firm was seeking an individual to stand as the
class representative at the time of this story. This individual has been found.
Singleton Urquhart initiated the claim on December 6, 2005 by applying to the
Supreme Court of B.C. for certification of their action as a class action. They
expect that it will take 6 to12 months. “If the action is certified, then all
those that fit within the class described in the Statement of Claim will
automatically become plaintiffs in the Action, unless they opt out of the
class”, say Singleton Urquhart in a recent client alert (see their web site
www.singleton.com for details). If certification is successful, broad-based
advertising to inform concerned parties will follow.
We wish to commend the public-spirited owners who
have agreed to stand as the class representatives. They are residents of White
Rock and we are pleased to report are members of our Association.
