FAQ—Strata Fee Increase
Q Our Council has decided that next year’s operating budget should be
slightly higher and that it would be simplest just to raise everyone’s monthly
strata fee by $10.00. Some owners disagree and insist the new fees should be
recalculated using the unit entitlements. Who is correct?
A The objectors are correct. If you look at section 99 of the Strata
Property Act and associated regulations, you will find that the unit
entitlement method must be used. Complications arise in some circumstances and
are discussed in this section but there is no mention of the procedure that has
been proposed by your Council.
Also note that section 100 spells out the rules for
changing the method of calculating contributions to the operating fund. A unanimous vote is required if an
unusual formula is to be adopted. The resolution and a ‘Form E’ must be filed
with the Land Titles Office. If Council still wishes to use their $10 formula,
they must satisfy section 100.
